Terms of Service

These Terms of Service ("Terms") govern your access to and use of Secure VPN Unlimited (the "Service") provided by Fylfot Software Pvt Ltd ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading our application, or using our Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Fylfot Software Pvt Ltd.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

3. Account Registration and Security

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false or misleading information.

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. Details of available plans are provided on our website and in the application.

4.3 Payment and Billing Platform

All payments for the Service are processed exclusively through the platform you used to download the app:

• iOS (App Store): Payments, billing, and subscription management are handled entirely by Apple Inc. through Apple's In-App Purchase system. By purchasing a subscription on iOS, you agree to Apple's Terms of Sale. We do not collect or store your payment card details.
• Android (Google Play): Payments, billing, and subscription management are handled entirely by Google LLC through Google Play Billing. By purchasing a subscription on Android, you agree to Google's Terms of Service. We do not collect or store your payment card details.

Prices are displayed in your local currency as determined by the App Store or Google Play at the time of purchase. You agree to pay any applicable taxes as required by your platform or jurisdiction.

4.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Auto-renewal and billing are managed by Apple (iOS) or Google (Android) — not by Fylfot Software. You will be charged at the then-current price for your subscription plan, confirmed at the time of purchase.

4.5 Price Changes

Subscription prices may be updated from time to time. Price changes are managed through the App Store or Google Play and will take effect at the start of your next billing cycle. Apple and Google will notify you of price changes in accordance with their respective policies.

5. Refund Policy

Because all purchases are processed by Apple or Google, refund eligibility and processing are governed by their respective policies:

5.1 iOS Purchases (Apple App Store)

Refunds for purchases made through the Apple App Store are managed entirely by Apple. We cannot issue refunds directly for iOS purchases. To request a refund:

• Visit reportaproblem.apple.com and sign in with your Apple ID
• Select the Secure VPN purchase and follow Apple's refund request process

Apple's standard refund policy applies. We support any refund request you make to Apple, including during the free trial period.

5.2 Android Purchases (Google Play)

Refunds for purchases made through Google Play are managed by Google. For purchases within 48 hours, Google may refund automatically. Beyond that:

• Visit play.google.com/store/account/subscriptions and select Secure VPN
• Follow Google Play's refund request process
• You may also contact us at support@fylfotsoftware.com and we will assist with your Google Play refund request

5.3 Free Trial

New users receive a 3-day free trial. If you cancel before the trial ends, you will not be charged. Trial management is handled by Apple or Google depending on your platform — cancellation instructions are in Section 6.

6. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access to the Service until that date. Since billing is managed by Apple or Google, cancellation must be done through the relevant platform:

• iOS: Go to Settings > [Your Name] > Subscriptions, select Secure VPN, and tap Cancel Subscription.
• Android: Go to Google Play > Profile icon > Payments & subscriptions > Subscriptions, select Secure VPN, and tap Cancel Subscription.

No refund is provided for the unused portion of a paid billing period, except as outlined in Section 5 or as required by applicable law.

7. App Store and Google Play Supplemental Terms

If you download and use the Service through Apple's App Store or Google Play, the following additional terms apply:

• Platform Terms: Your use is also subject to Apple's App Store Terms of Service or Google Play Terms of Service, as applicable. In the event of a conflict between these Terms and the platform terms, the platform terms prevail with respect to payment and distribution matters.
• Third-Party Beneficiary (Apple): Apple is a third-party beneficiary of these Terms for App Store users. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• Maintenance and Support: Fylfot Software Pvt Ltd is solely responsible for providing maintenance and support for the Service. Apple and Google have no obligation to provide any maintenance or support for the Service.
• Product Claims: Fylfot Software Pvt Ltd, not Apple or Google, is responsible for addressing any claims relating to the Service or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims.

8. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You may NOT use the Service to:

• Violate any local, state, national, or international law
• Transmit or distribute malware, viruses, or other harmful code
• Engage in any form of hacking, unauthorized access, or network interference
• Send spam, phishing attempts, or unsolicited communications
• Infringe upon intellectual property rights of others
• Engage in child exploitation or distribution of child sexual abuse material
• Engage in harassment, stalking, or threats against others
• Distribute copyrighted material without authorization
• Conduct denial-of-service attacks or similar malicious activities
• Resell or redistribute the Service without authorization
• Use the Service to hide your identity for illegal purposes

9. Service Availability and Modifications

We strive to provide reliable and continuous service, but we cannot guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Perform scheduled and emergency maintenance
• Implement updates and improvements to the Service
• Change server locations and features

We will provide reasonable notice of significant changes when possible.

10. Intellectual Property

The Service and all related content, features, and functionality are owned by Fylfot Software Pvt Ltd and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or alter any copyright, trademark, or proprietary notices
• Use our trademarks or branding without written permission

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We maintain a strict no-logs policy regarding your VPN browsing activity and connection logs.

12. Disclaimers and Limitations of Liability

12.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee of Security

While we implement industry-standard security measures, we cannot guarantee that the Service is completely secure or free from vulnerabilities, bugs, or errors. You use the Service at your own risk.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYLFOT SOFTWARE PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fylfot Software Pvt Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any third-party rights

14. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you:

• Breach these Terms
• Engage in prohibited activities
• Provide false or misleading information
• Fail to pay applicable fees

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in English. The arbitration shall take place in India.

15.3 Exceptions

Notwithstanding the arbitration clause, either party may seek injunctive relief in court to prevent actual or threatened infringement or misappropriation of intellectual property rights.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your subscription.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fylfot Software Pvt Ltd regarding the Service and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Fylfot Software Pvt Ltd.

20. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICE.
